Montana Standard on Mixing Zones Not a Violation of Clean Water Act
The US Court of Appeals for the Tenth Circuit has determined that Montana's water quality standard that exempts mixing zones from compliance with the water quality criteria under the Clean Water Act (CWA) was not itself a violation of the act. A mixing zone is an allocated impact zone in which acute and chronic water quality criteria may be exceeded as long as a number of protections are maintained.
