Water Board lacked Jurisdiction
An appeals court upheld the ruling that Oklahoma Water Resources Board was out of its jurisdiction when it investigated Matador Pipelines, Inc. for violations of water quality standards relating to oil leakage into Barney Creek. Oklahoma state law confirming certain powers on the Water Resources Board expressly stated that the board, in setting standards, may not take into consideration the impact of activities related to acceptable petroleum operations. Thus, the petroleum industry was exempt from water quality standards.
