Michigan Wetlands Are Under Jurisdiction of Corps of Engineers
In a decision only recently reported, the US Court of Appeals for the Sixth Circuit has ruled that a connection between wetlands on private property and an adjacent nonnavigable ditch was significant enough for the wetlands to be considered “adjacent waters” within the jurisdiction of the US Army Corps of Engineers under the Clean Water Act (CWA).
