Test‐year Comparison Called Misleading
The Public Service Commission compared Heater of Seabrook's test‐year expenses with prior calendar years and determined that Heater had not justified its need for a rate increase. The PSC also deviated from past practices of considering availability fees as contributions in aid of construction, instead counting the fees as operating revenue. The trial court affirmed the PSC. The appellate court reversed the decision stating that the PSC's comparison of prior nontest years with the test year was misleading, and that no substantial evidence supported the PSC's decision regarding the issue of availability fees. The case was sent back to PSC for further proceedings.
