The author has to own up to being the originator of ‘consultant switch’ as the name of the process sometimes employed where there is a design and build contract. The ‘switch’ usually takes place when the design and build contractor’s tender is accepted by the employer. Novation is a completely different process in which the employer and the consultant sign an agreement for the consultant to carry all the services during the whole of the process from initial briefing to completion of the construction. When the contractor’s tender is accepted, a three‐party agreement is signed which effectively transfers the agreement between employer and consultant into an agreement between contractor and consultant just as though the contractor had been in the place of the employer from the beginning. Novation is sometimes used instead of consultant switch, but neither novation nor consultant switch is to be recommended.
