Flow limited for inefficient irrigators
In September 1981, the Department of Ecology filed a petition to clarify existing rights to divert, withdraw, or otherwise make beneficial use of the surface waters and groundwaters of the Marshall Lake and Marshall Creek drainage basin. A referee took testimony. Clarence and Peggy Grimes submitted five claims for water rights, including one for use of waters for domestic supply, irrigation, and recreation. They requested an instantaneous flow rate of 3 cfs for irrigation and a storage right of 1,520 acre‐ft in the reservoir. The trial court adopted the referee's recommendations that the claim be confirmed but limited to an instantaneous flow of 1.5 cfs and a storage right of 183 acre‐ft plus 737 acre‐ft for evaporative loss.
