Oil Company Responsible for Gasoline Cleanup
Aviation Oil Company owned and operated a retail gasoline station between 1963 and 1985. In 1984, Aviation began a major renovation that included replacement of the underground tanks, pipes, and pumps. In November 1984, residents of two nearby homes detected gasoline in their water. Testing by the Department of Environmental Protection (DEP) concluded that the station was the source of the gasoline and that it was discharged during Aviation's ownership. DEP ordered a cleanup. The disputed order was affirmed by the Board of Environmental Protection, and a trial court affirmed the Board's decision.
