Kodak Can Discharge Unlisted Pollutants
Eastman Kodak Company operates a factory in Rochester, New York, that discharges wastewater into the Genesee River and Paddy Hill Creek under a State Pollutant Discharge Elimination System (SPDES) permit issued in 1984 pursuant to the Clean Water Act. The permit established effluent limitation for 25 pollutants; it also established action levels for those pollutants and for 5 other pollutants. This action arose out of an ongoing dispute during which Atlantic States Legal Foundation had claimed that Kodak extended the effluent limits imposed by the permit and discharged pollutants it had no authority to discharge. The trial court ruled in favor of Kodak.
