Utility Condemnation Prevented
Missouri Cities Water Company (MCWC), a private corporation, owned a water treatment system in the City of Mexico. MCWC served an area under a certificate from the Missouri Public Service Commission (PSC). A controversy arose from the city's displeasure over a 61 percent rate increase for service to MCWC's customers from 1984 to 1991. The city challenged the rate increase but did not appeal an adverse decision. Thereafter, the city determined a municipal system would save money for residents. After its two offers to purchase MCWC were rejected, the city ordered acquisition of the Mexico division by condemnation. The trial court granted the condemnation but stayed enforcement to allow MCWC to seek an order of prohibition.
