One of the key things which all clients expect is that their professional advisors are able to select the most suitable form of building contract for the particular project. The appropriate contract will perfectly fit all the criteria. But most contracts which are used are standard forms and may not fit all the criteria. Having put together the criteria, effectively the brief for the contract, one should be able to advise the client about any desirable amendments to the contract. Just giving a standard contract to a solicitor is inviting him or her to carry out wholesale amendments just because they believe them to be an improvement. It is worth remembering that a person who advises the employer to use the wrong form of contract which results in the client suffering a loss may be liable to be sued for negligence.
