Board Justified in Denying Petition
An electric utility sought site‐specific water quality standards for groundwater located at a generating station. By 1984 the storage capacity of the pond, built adjacent to the station in 1968, was nearly depleted. The utility was denied a permit to construct a second pond adjacent to the first. Next the utility sought site‐specific standards to allow it to exceed the maximum contaminant levels permitted by the general standards. The Pollution Control Board denied this petition as well. An appellate court reversed the Board's decision, but this decision was reversed again by the state supreme court.
