Sometimes the employer wants to be able to let other contractors access the site in order to carry out work. It is important to be clear that the law will say that a contractor who is given a project to construct is entitled to have exclusive possession of the site in order to construct it unless the building contract specifically states otherwise. There are no real advantages and a great many disadvantages for the employer who insists on bringing persons, other than the contractor, onto the site. One only has to consider for a moment the enormous complications facing the average‐sized contractor organising and carrying out a contract of moderate size. The contractor will almost certainly be entitled to extensions of time, loss, and/or expense, and possibly be able to terminate its employment under the terms of the contract.
