Unit System Invalid
Pier House Joint Venture converted a factory with related office and retail uses employing up to 90 people to a 24‐unit hotel and spa. The Florida Keys Aqueduct Authority charged Pier House a system development fee of $48,000 for potential increased demand on the Authority's water system because of the conversion. The authority had counted the former factory as one unit because it was a single commercial establishment, whereas it counted the converted hotel as 24 units because it had 24 residential guest rooms. Thus, the authority determined that the converted hotel could increase demand on the water system 24‐fold, and it imposed a $2,000‐per‐unit system development fee. Pier House challenged the assessment, and the trial court declared the fee invalid.
