Adjudication is very common and it will be useful to set out in simple terms some basics which every architect should know. Strictly, there are two kinds of adjudication: statutory and contractual. Statutory adjudication is imposed by Parliament, like it or not, on every construction contract. Contractual adjudication is when the adjudication process is stated in the contract as being one of the dispute resolution procedures. Before an adjudicator can be asked to decide a dispute, there must be a contract between the two parties. The contract may be in writing or oral. The party serving the Notice of Adjudication (the Referring Party) must serve it on the other party (the Responding Party) and the claim itself (the Referral) must be given to the adjudicator with a copy to the other party within seven days of the date of the Notice of Adjudication.
