Fayetteville Wins Rate Argument
In February 1981, the city of Fayetteville, Arkansas, entered into a 20‐year contract to provide water to the Mount Olive Water Association. The price was to be set by the city from time to time. In November 1990, the city established much higher water rates, increasing them from $0.765/1,000 gal in the original contract to $2.40/1,000 gal by January 1, 1994. Mount Olive refused to pay the higher rates. The city sued for damages amounting to the difference between the higher rate and the amount Mount Olive was willing to pay. The trial court awarded the city nearly $140,000.
