Municipality Can Impose Personal Liability on Property Owners
Joseph and Marjorie Skupien owned and leased mobile homes in the borough of Gallitzin, Pennsylvania. The borough had an ordinance that provided for the regulation of its water system, whereby owners and lessees of property, if served by the water system service, were jointly and severally liable for the payment of “water rentals and penalties hereby imposed.” The Skupiens brought suit seeking to have the ordinance declared unconstitutional because it unreasonably made an owner leasing property personally liable for water service provided to tenants under a contract between the tenant and the water system. The trial court ruled for the borough.
