US Supreme Court to Consider Hearing Significant Stormwater Runoff Decision
A Ninth Circuit Court of Appeals case, Natural Resources Defense Council Inc. v. County of Los Angeles [636 F.3d 1235 (9th Cir. 2011)], is being considered by the U.S. Supreme Court for review. The case presents issues of nationwide significance for all operators of municipal separate storm sewer systems (MS4). This case, if allowed to stand and not be overturned by the Supreme Court, could have far‐reaching implications and create confusion for the lower courts in deciding future MS4‐related matters.
