Wholesaler Can Develop Its Own Resources
Jennings Water, a rural nonprofit water association in Jennings County, Indiana, was formed in 1975 through the merger of two local companies, Geneva Township Water Corporation and Muscatatuck Water Corporation. Both were financed by Farmers Home Administration loans, which Jennings assumed. CSL Utilities, a private nonprofit utility company, was founded in 1974 to supply water at retail to residents of a Jennings County subdivision. CSL first received its wholesale water from Geneva and later, after the merger, from Jennings. In 1987, the state regulatory commission approved a nearly 100‐percent rate increase for Jennings. In response, CSL sought to secure another water source by building its own system. CSL sought a declaration that its proposal would encroach on its service and thus curtail it. The federal trial court ruled for Jennings.
