As water shortages increase, many states are reexamining their existing laws. They doubt that common‐law water rights doctrines, prevalent in the East and South, are adaptable to present‐ day conditions. They feel that these traditional doctrines invite litigation. This is certainly true of riparian rights, which cannot be definitely measured or limited under the common law. The article discusses examples of litigation across the country.
