Water haulers can join water association
Three Kentucky utilities‐‐the Boone County Water and Sewer District, the Campbell County Kentucky Water District, and the Kenton County Water District #1‐‐were considering merging. The state Public Service Commission (PSC) conducted an audit as part of a merger feasibility study and sought to charge the utilities for the cost of the study. The PSC had broad statutory power to investigate the feasibility of the merger of water districts. However, the state granting this power was silent with regard to audit charges. Another state law granted the PSC authority to conduct management audits to be borne by the utility. Thus, the PSC argued it should also be allowed to do the same in merger studies. The trial court ruled against the PSC.
