Rights and liabilities of water suppliers arising from groundwater pollution
Suppliers of water are subject to exceptionally high standards of care towards the consuming public. Even where contamination is not the result of negligence on the supplier's part, he may be held strictly liable for all resulting injuries to users. Moreover, very small concentrations of organic chemicals in drinking water supplies, detected by sophisticated modern measuring techniques, may be grounds for health authorities closing wells and consumers claiming damages against the supplier for sickness and disease. Suppliers should, therefore, test for priority toxic pollutants (PTPs) and learn both the waste disposal practices and groundwater flow systems of their watersheds, in order to formulate and pursue preventive strategies before trouble occurs. Such strategies may include reduction of pumping rates, demands for land‐use controls in critical recharge zones, and lawsuits for damages and injunctions against upstream sources of contamination.
