Private Water Company Loses Sole‐Supplier Status
Water Development Corporation (WDC), a private corporation, was formed in 1960 to own and operate a water system in Polk County, generally outside the corporate limits of Des Moines. The Water Works (WW) was a utility board of Des Moines that managed and controlled the water treatment plant and distribution system serving the residents of the city and neighboring areas. In 1988, the city annexed part of Polk County. WDC served 45 customers in the annexed area. WDC sued WW, alleging inverse condemnation of its property, intentional interference with contracts, and unfair trade practices. The trial court ruled against WDC.
