Retroactive Billing Denied
Edmund J. Quirion owned a parcel of land in Weld, Maine, that contained a spring that provided water to several nearby seasonal cottages. Several cottage owners complained to the Public Utilities Commission (PUC) in 1995 that Quirion had refused to provide water to their cottages. PUC held a hearing investigating the charges and the rates Quirion charged for water service. A similar complaint had been made in 1990 and it was found that Quirion was operating a public utility. The PUC ruled that Quirion couldn't issue bills for the years preceding the investigation. The appellate court upheld the PUC ruling.
