Retroactive Ratemaking Denied
In 1987, the Montana legislature mandated that private water service providers were to pay for maintaining pipelines from the main to the owner's property line. The day the law went into effect, Mountain Water Company filed a complaint in the federal courts against the state Public Service Commission (PSC), seeking to have the law declared unconstitutional. The courts upheld the law. In 1989, Mountain applied with PSC to increase its rates, in part to recover previous expenditures it had been compelled to provide for its customers under the new state law. The PSC denied recovery for the previous expenditures. The trial court, however, ruled for Mountain. The trial court decision was reversed on appeal.
