Recalcitrant fire hydrant not municipality's fault
Ben A. O'Dell purposely set fire to an old chicken house on his property. The fire got out of control. To protect his old house, O'Dell sprayed water on its south side, but his efforts were unsuccessful and it also caught fire. When firefighters hooked up their hose to the fire hydrant, it supplied no water. O'Dell's new house then caught fire and was also destroyed. He sued Breckenridge, Missouri, alleging the malfunctioning hydrant was a dangerous condition of public property. The trial court ruled for the city.
