Water and Sewer Line Extensions Owned by Utility
In a dispute involving the question of ownership of main extensions constructed by and at the expense of private property owners, a New Jersey appellate court concluded that a utility authority owned off‐site water and sewer lines built with approval of the authority. The claim by the property owners relating to another property owner's request to tie into the line, the court stated, should be made to the authority, who should apportion the cost of the line extensions among the property owners benefited and reimburse them for costs in excess of their fair share.
