Connection Charge Not Considered an Equitable Allocation of Costs
According to the Supreme Court of Nevada, a water district's imposition of connection fees as a precondition of obtaining new or expanded water service was outside its authority. According to the court, the water district could charge a connection fee only if the fee were used to recover costs related to the properties charged. The court concluded that new customers should not be forced to pay a connection fee that is spend on a facility that may not benefit them or that benefits all members of the systems.
