Judges Wrong to Require Equal Water Rates
The City of South Boston, Virginia, initiated a proceeding to change its status from city to town. A special three‐judge court was appointed to decide the city's petition. The court entered a final order that permitted the city to revert to town status subject to certain conditions, one of which was a requirement that the new town's water and sewer rates shall be equal for customers of the new town and Halifax County. The City appealed. The special court decision was reversed.
