Land cases are increasing and varied, given the increasing need for the land, it also increases the need for legal certainty in the land sector. In providing legal certainty, it is necessary to have a complete and clear written legal instrument and be implemented consistently and provide convenience to the right holders of the land. The landowner does not by itself become the owner of the building erected on the land. A building may be built on someone else's land, usually in accordance with the agreement made between the landowner and the owner of the building. The issue of home ownership that has not yet been certified often creates many problems that may occur in the future, considering that the house is a building that stands on land that must be registered to the Land Office. From the description of the case study conducted ownership of the house on State land precisely in the area of North Kalimantan Nunukan.
