L’inversion des rôles ? Aménageurs, promoteurs immobiliers et pouvoirs publics dans la régulation des ZAC du Grand Lyon
Urban development arises from multiple interactions between stakeholders. What can be defined as public or private sector interventions is becoming complicated. In this article, we study the stakeholder’s games happening in a particular French land development procedure, the “Zone d’aménagement concerté” (ZAC). The ZAC is a legal framework that allows the public sector to delimit an area for future development and to negotiate the program with the potential developers (either public or private). It is often defined as the main tool to drive public urban development projects. We show that the evolution of the legal national framework since about 20 years are lowering the characteristics of the ZAC, which becomes a tool among others for planning authorities to drive urban land developments. In order to drive developer’s activity, local authorities can still have a strong power but they now also have to choose among many land policy tools. In a second part of this work, we demonstrate that a very proactive role of the planning authority and the establishment of strict (or even binding) financial and land use rules can be appreciated by land and real estate developers. First, this shows that private investors don’t mainly ask for deregulation and for free market enforcement, but rather for clear and stable legal and financial frameworks. Secondly, the main role of French public planning authorities is changing. From a role of land developer, their main goal now is to offer the most favorable investments opportunities to target private developers’ involvement in urban projects
