Insurance Companies Liable for Cleanup of Toxic Waste
At issue was whether, under comprehensive general liability (CGL) insurance policies issued to FMC Corporation, the insurers were obligated to provide coverage to FMC for costs incurred pursuant to the federal Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) and related state and federal environmental laws. FMC held more than 60 primary and excess CGL policies issued by several insurers. Several state and federal agencies sued FMC for alleged violations of CERCLA and other environmental laws, claiming that FMC was responsible for contamination of 79 hazardous waste disposal sites, groundwater beneath them, aquifers beneath adjoining property, and surrounding surface waters. The state supreme court concluded that the insurance companies were obligated for repair property damage caused by toxic discharges but not for measures taken solely to prevent future damage.
