Cleanup Costs Not Covered by Insurance
In 1965, Bausch & Lomb Incorporated (B&L) purchased a plant that had manufactured parts used in telescopes and microscopes. From 1958 through 1975, waste plating liquids, solvents, and wastewaters were disposed of in an onsite waste disposal system. In 1982, B&L first learned that soil behind the plant contained a potentially hazardous substance, cadmium, at levels in excess of those permitted by federal regulations. Further study revealed additional contamination by another organic solvent. In June 1987, the neighboring property owner informed B&L of damage to the groundwater on its property and threatened litigation. B&L notified Utica Mutual Insurance Company, its insurer under successive comprehensive general liability (CGL) policies. B&L requested Utica to pay for cleanup costs and for damages to the adjacent property. Utica unsuccessfully sought a declaration that it was not liable. The decision was reversed on appeal.
