The North Park Public Water District in Illinois had water mains and valve boxes within the corporate boundaries of the village of Machesney Park and beneath its roads. The facilities were in place before the village was incorporated. Subsequently the village began road improvements and drainage work, requiring that the water mains be lowered and the valve boxes readjusted to grade. The village's assessment provided no funds for these changes, and the water district lacked the power of special assessment. The water district sought a declaration that the village was legally obligated to reimburse for its anticipated relocation expenses of $38,000. The trial court ruled for the village.
