Western Legal Cases Address Water Deliveries and Groundwater Export: NEVADA COURT STRIKES DOWN LAS VEGAS GROUNDWATER EXPORT APPROVALS
The Seventh Judicial District Court of Nevada recently struck down the Nevada State Engineer's approval of the Southern Nevada Water Authority's (SNWA) permits allowing the importation of groundwater from the Cave, Dry Lake, and Delamar valleys in eastern Nevada. In July 2008, the state engineer issued Ruling 5875, which approved SNWA's right to pipe up to 18,755 acre‐ft to Las Vegas from the three valleys each year. The court based the ruling on its finding that the state engineer had not held SNWA to the same requirements to demonstrate the effects of the proposed exports to which it had held prior applicants.
