Permit Condition Properly Imposed
The Municipal Water Authority of Butler Township served 1,895 customers. The authority owned the lines, hydrants, water tanks, and all other water facilities and bought its water in bulk from the Pennsylvania American Water Company (PAWC). PAWC uses surface water and so may withdraw water only as authorized by the Department of Environmental Resources (DER). In December 1991, the DER, acting on an application for a water allocation permit from the authority, told the authority to install meters to determine water loss and daily use in its system. The authority challenged the condition, but the Environmental Hearing Board (EHB) sustained it.
