Most building contracts include a period after the contractor has completed the Works which is variously called the 'defects liability period' or even, more misleadingly, the 'maintenance period'. The idea is that any defects (i.e. work not in accordance with the contract) which appear during the period are reported to the contractor and the contractor is allowed to come back onto the property to rectify the defects at its own cost. If there was no rectification period, the employer, after notifying the contractor of any defects, could arrange to have them corrected by another contractor and charge the original contractor with the cost. The general principle is that the architect, or sometimes the employer, must notify the contractor during or at the end of the rectification period listing all the defects which have been found by inspection. The contractor should make good the defects within a reasonable time following notification.
