Private Water Utility Must Reimburse Customers
In Montana publicly owned water utilities are regulated by their respective cities or towns, and the Public Service Commission (PSC) regulates privately owned water utilities. Customers of privately owned utilities own the service lines that connect their premises to the water main in the public street. Before 1987, these customers bore both financial and actual responsibility for maintaining the service lines. In 1987, the state legislature required privately owned–but not publicly owned–utilities to reimburse their customers for certain of such repair costs. The Mountain Water Company (MWC), a private water utility, challenged the law, but the trial court upheld it.
