The invention discloses a ballastless track railway deformation adjusting embankment structure and a construction method thereof. The structure comprises an adjustor fixing foundation, a bearing device and a deformation adjustor, the adjustor fixing foundation is used for being arranged on an embankment filling body, the deformation adjustor is fixedly arranged at the top of the adjustor fixing foundation, and the bearing device is arranged at the upper end of the deformation adjustor; and the deformation adjuster is used for driving the bearing device to ascend or descend. The construction method is used for constructing the embankment structure. When the unfavorable deformation amount generated by the railway foundation exceeds the ballastless track railway requirement, the bearing device is driven to ascend or descend upwards or downwards through the deformation adjustor, the height of the bearing device is adjusted, and the requirement of the ballastless track railway on vertical deformation is met, so that the treatment strength of the soil foundation can be reduced, foundation treatment engineering investment can be saved, or adverse effects caused by inaccurate foundation investigation can be avoided, and the problem that the soil foundation generates new uncertain and uneven settlement deformation due to underground water pumping or loading influences near a railway canbe solved.
