The limitation period is mostly something which has been decided by Act of Parliament. It is important for architects in various ways. Actually, there are several different limitation periods. They are called ‘limitation’ because they limit the periods during which a person may start successful legal proceedings in various circumstances. This chapter focuses on the periods most likely to affect people in the construction industry. Where simple contracts are concerned, the period is 6 years from the date of the breach of contract. If the contract is a deed, sometimes known as a specialty contract, the limitation period is 12 years from the date of the breach. Negligence, trespass, nuisance, and several other less common situations are all called by the collective name of ‘torts’. In the case of negligence, the limitation period commences when the damage occurs and the period is 6 years.
